Terms
This is an agreement between Academy of Companion Animal Nutrition (“ACAN”), and the person enrolling in this course (“Student”). This agreement will become effective upon the Student being given access to the Professional Canine Formulation Course and the Specialty in Canine All Life Stages Formulation Course.
By purchasing, the Student acknowledges and confirms that:
ACAN Courses
I. The Student is at least 18 years of age
II. The Student is comfortable in communicating in English with the instructors of the course, and can submit assignments in English.
III. The Student has reliable access to internet connection. All materials for the course are presented in an online format and cannot be accessed offline.
IV. ACAN is a private company that is not an accredited college, university or technical school. ACAN provides educational material for professional development or for personal interest.
V. Students enrolled in the audit version of the Professional Canine Formulation Course and Specialty in Canine All Life Stages Formulation Course are prohibited from using ACAN copyrighted materials, including but not limited to the designation “Cert. PCF” or “Sp. ALS” and any ACAN logos, for any personal, professional, or commercial purposes. Use of these credentials and materials is reserved exclusively for students enrolled in the certificate version of the course.
Enrollment Periods
I. Access to the Professional Canine Formulation Course and Canine All Life Stages Formulation Course are time limited. The enrollment fee of $495 USD is considered a subscription fee for the 18 months of access to both courses. After 18 months, the Student will no longer have access to either course. Upon the expiration of the access period, the Student’s access to course content will be automatically terminated, and continued access will require re-enrollment under the then-current terms and fees.
II. Enrollment extensions may be available to the Student on a case by case basis. Extensions extend the Student’s enrollment period for the length of time explicitly stated when granting the extension. Extensions may require an additional fee.
III. Enrollment extension requests are not guaranteed to be approved.
Payment and Refunds
I. ACAN does not provide refunds for the course under any circumstances. The Professional Canine Formulation Course and Canine All Life Stages Formulation Course are self-paced and refunds cannot be given due to the Student’s inability to complete the course. Once the Student is given full access to the courses on the ACAN website, this satisfies as the delivery of the purchased goods and services to the Student.
II. Payment for the Professional Canine Formulation Course and Canine All Life Stages Formulation Course is due, in full, before enrollment is granted.
Conduct of Behavior
I. The Student’s continued enrollment in the course is contingent upon the Student’s upholding and adhering to ACAN’s policies and rules, including ACAN’s standards of integrity.
II. The Student will maintain professionalism with ACAN instructors during the course enrollment.
III. The Professional Canine Formulation Course and Canine All Life Stages Formulation Course are copyrighted material. The Student may not use the material for commercial purposes, or redistribute the material to any third party without prior written consent from ACAN and the instructors of the course. Should any current Students or graduates be found redistributing material, they will be removed from all ACAN courses (if currently enrolled), be revoked of any rights to use ACAN designations, such as “Cert. PCF” or “Sp. ALS”, and risk legal action.
IV. ACAN will not maintain copies of the Student’s submitted assignments indefinitely. Should the Student want to keep records of their work, they will need to do so on their own.
V. The Student will not interact with any companion animals or consult on the nutrition or diet of a companion animal as a part of their studies for the Professional Formulation Course or Canine All Life Stages Formulation Course.
VI, Should the Student offer professional nutrition services, ACAN nor the instructors of the Professional Canine Formulation Course or Canine All Life Stages Formulation Course, are responsible for the Student’s work, including the legality or safety of the services.
ACAN Classrooms
I. The Canine All Life Stages Formulation Course and ACAN Classrooms are optional and are not required to complete or pass the course.
II. The Student must adhere to the Classroom Code of Conduct to retain access to the ACAN Classrooms. Breaking any rules may result in the Student being removed from the Classrooms with no opportunity for readmittance.
III. Any material and discussions posted in the classrooms are copyright protected by the author of the message and ACAN. Distributing the contents of the classroom discussions is prohibited.
Intellectual Property Ownership
The Student acknowledges that all right, title and interest in and to the Professional Canine formulation Course, Canine All Life Stages Formulation Course, and associated ACAN content remain with ACAN and the instructors of the course, except as expressly set forth in this Agreement. This Agreement is not a sale of the Professional Canine Formulation Course, Canine All Life Stages Formulation Course, or ACAN and does not convey to the Student any rights of ownership. The right to distribute the Professional Canine Formulation Course and Canine All Life Stages Formulation Course, and the right to allow individuals to use ACAN logos, designations, or names remains exclusively with ACAN.
Waiver
ACAN does not guarantee that the Student is knowledgeable, experienced, or qualified to work professionally with companion animals after taking this course. The Student is always responsible for their actions and the Student should always take precautions to make sure their actions do not pose a danger to any person(s) or animals.
The Student releases and holds harmless ACAN and its instructors from any claims, litigation, actions, suits, damages, costs, fees, including reasonable attorney's fees, losses, injuries or illness as a result of a claim that may arise from the actions of the Student. In no event shall ACAN’s, or its instructors’, total liability to the Student for all damages, losses and causes of action (whether in contract, tort, including negligence or otherwise), exceed the cost of the Student’s enrollment fee.
The Student warrants that they have full legal authority to enter into this contract.
